I will ship folded for $8 THIS POSTER WAS PRINTED BY DONALDSON. I DO NOT KNOW WHY IT WAS WITH THE COLORCRAFT COLLECTION OF POSTERS. MY GUESS IS THAT THE 2 COMPANIES WORKING IN DIFFERENT REGIONS WERE FRIENDLY TO EACH OTHER. THIS AND 4 OTHER POSTERS FROM "FAIR PUBLISHING HOUSE" THAT I AM LISTING WERE WITH THE COLLECTION FROM COLORCRAFT. EACH ONE HAS A DIFFERENT NAME ON THE BACK FOR SOME UNKNOWN REASON. Bleistein v. Donaldson Lithographing Company, 188 U.S. 239 (1903), is a case in which the United States Supreme Court found that advertisements were protected by copyright. The case is now cited for the proposition that commercial speech can be protected by copyright. The Donaldson Lithographing Company started out as a small lithographing business based in Cincinnati, Ohio (August 10 1863). William M. Donaldson and Henry Elms founded the company as partners until Elm’s death in 1872. After Elm’s death, Donaldson was left to be solely in charge of the company. In 1883, Donaldson officially incorporated the business as Donaldson Lithograph Company. The company flourished after relocating to Newport, Kentucky in 1898. Donaldson added another location in Covington, Kentucky that specialized in creating art signs. William Donaldson died in 1931 on the 22nd of October. He was 91. The company stayed in the family until 1981.It is important to note that the Donaldson Lithographing Company was sued by Courier Lithographing. Courier Lithographing sued Donaldson on the basis of copyright infringement. A local circus had first asked Courier Lithographing for x amount of prints for advertising. After the circus realized they needed more prints, they decided to ask Donaldson as his services were cheaper. Courier then sued Donaldson for copyright protection. Donaldson believed that copyright should be restricted to fine arts and that lithographs for advertising did not fit the category of fine art. After going through the trial and appellate court who were both in favor of Donaldson, the case was brought to the US Supreme Court. The Supreme Court ruled that when a judge is evaluating copyright infringement that they cannot make any judgment based on the artist or the quality of their work. In legal terms, this ruling is known as the Bleistein Nondiscrimination Principle I have been contacted by the original owner's Son and Granddaughter and they have passed along this info to me. I very much appreciate it. Robert Curran and Harold Braucht rented a little space at the Oklahoma Publishing Co in the corner of a room in 1933 with one roller press. Robert was in charge of the art & production, and Harold was the sales and promotion guy. The early posters had the art drawn on wood, for each color and the wood carved away to elevate the printing surface. They then used block letter type faces to complete the layout. As the business grew they moved into a couple of locations on their own, and purchased more presses from a firm in Chicago.Those huge presses were so loud, almost all of the printers had hearing problems later in life. They were early users of lithography printing, making their own plates and photographic work. They pretty much stayed with entertainment printing. Circuses, and Amusement attractions. They did print a world war 2 bond poster, with the Minute Man and the Pioneer Woman statue on it. One may still be hanging in the state capital. They did snipe printing for the Clyde Beatty Circus, and Barnum & Bailey Circus. To save the cost of shipping paper, sent the plates to a little shop they established in Lodi Ca. During WW2, they enticed one of the Carnivals to set up in downtown Okla. City near the Civic Center to entertain the military men stations at Will Rogers, and Navy men from Norman. Later they booked Broadway show touring company's in Okla.
