The dispute involved Kroger instituting something called an "O.R." program -- Operating Ratio -- that involved calculations of profit regarding workers, wages, but also involving advertising, marketing and non-specifically-labor-related issues. Kroger refused to honor the workers' unions' requests for information on the O.R. program, citing confidentiality issues; the NLRB found in favor of the unions and ordered Kroger to turn over information on the program which they averred directly affected the workers and the terms of their employment. The Supreme Court reversed their decision and found, in 1968 on behalf of Kroger, arguing that the need for the information on O.R. was "theoretical," and that the unions had enjoyed a good working relationship with Kroger from 1943 to date, and that the need for confidentiality in the face of competition outweighed the theoretical needs of the workers. The first volume covers the original dispute with NLRB and includes "Brief for the Kroger Company" with Unkovic's pen marks and notes to covers and occasional marks to text; the brief from the NLRB, the brief for the Amalgamated Meat Cutters (etc.) and various other petitions. Approximately 300 pp. The second volume, 1146 total pages, includes "Joint Appendix, Vol. I," Unkovic's own copy with a few marks to text and notes to rear wrap; Vol. II likewise with notes to rear wrap, and Vol. III with "NU" in ink on front cover. The third volume covers the Supreme Court case and includes "Petition for a Writ of Certiorari to the USCA for the 6th Circuit and Appendices," "Brief for Respondent, the Kroger Co. in Opposition," and two additional, substantial petitions for writs of certiorari.
